NOTICE OF SALE
Under and by virtue of the power and authority contained in NCGS 28A-17-2, 28a-17-8 and NCGS 29A-1-339.17, and pursuant to the Order of the Clerk of Superior Court for Dare County, North Carolina, entered in this special proceeding on April 22, 2026, and authorizing the undersigned to proceed with the sale of the real property belonging to Janson Fros, the decedent, Linda H. McCown, will offer for sale at public auction to the highest bidder for cash, at 10:30 a.m. on Thursday, May 14, 2026 at the door of the Dare County Courthouse, 962 Marshall C. Collins Dr., Manteo, North Carolina, that property, and any
improvements thereon, located in Wanchese, North Carolina, and more particularly described as follows:

BEGINNING at a concrete monument being in and marking the north margin or right of way of NCSR 345, a road in the Village of Wanchese with a 60 foot right of way, said point being in and marking the southeast corner of property now or formerly identified as Etheridge on a plat by Herndon F. Pyatt, Jr., dated 24th of August, 1979, running thence along the Etheridge east line North 27 deg. 38 min. 30 sec. East 167.32 feet to an iron pin being in and marking the Daniels land; running thence along the south line of said Daniels land South 82 deg. 16 min. 30 se. East 7.41 feet to an iron pin being in and marking the northwest corner of property now or formerly owned by Nellie Barnett; running thence along the west line of the said Nellie Barnettt property South 00 deg. 30 min. 34 sec. East 178.86 feet to an iron pin being in and marking the southwest corner of the said Nellie Barnett lot, said pin being in and marking the north margin or right of way of NCSR 345; running thence along the north margin of NCSR 345 North 69 deg. 55 min. 32 sec. West 92.15 feet to the point or place of beginning.
The record owner of the above-referenced real property as reflected in the public records of Dare County Public Registry not more than ten (10) days prior to the posting of this Notice are Lucas Willim Fros, Lilliann Rose Fros and Tanner Everett Peterson.
The above-described real property will be sold subject to any and all superior mortgages, deeds of trusts and liens, including without limitation, the lien of unpaid taxes and assessments, easements, conditions, restrictions and matters of record.
Pursuant to North Carolina General Statutes Section 29A-1-339.25, any successful bidder may be required to deposit with the undersigned immediately upon conclusion of the sale, a cash deposit in an amount not to exceed the greater of five percent (5%) of the bid or On Thousand Dollars ($1,000.00), whichever is higher. If the highest bidder fails to make the required deposit, the person holding the sale may at the same time and place immediately re-offer the property for sale. The sale will be reported to the Court and will remain open for advance or upset bids for a period of ten (10) days. If no advance or upset bids are filed with the Clerk of Superior Court, the sale will be confirmed. Any successful bidder shall be required to tender the full balance of the purchase price so bid in cash or certified check or cashier’s check at the time a deed is tendered to the property or the undersigned attorney attempts to tender such deed, and should said successful bidder fail to pay the full balance of the purchase price so bid at that time, he shall remain liable on the bid as provided for in North Carolina General Statutes
Section 29A-1-339.30.
