NOTICE
The Town of Duck Board of Adjustment will conduct a Public Hearing on November 6, 2026, at 10:00 a.m. to receive comments relating to the following variance application:
BOV-2026-003 An application submitted by property owner Spark Power, LLC, concerning the property at 1193 Duck Road, also known as Roadside Bar & Grill. The applicant seeks to reconstruct a non-conforming structure within the front setback and expand it to the east and west to provide ADA accessibility. The applicant also seeks to construct the western addition 9.9 feet from the front property line, requiring a variance of 5.1 feet from the minimum front setback.
Town Code Section 156.073(B) requires a non-conforming structure, or the affected portions of it be reconstructed in conformity with Chapter 156 if the structure is destroyed by any means to an extent exceeding 50% of its replacement cost.
Town Code Section 156.036(D) requires a minimum setback of 15 feet from the property line.

Any person may appear or be represented by an agent to present testimony on this variance application. Written comments may be submitted to the Town Clerk, Town of Duck, P.O. Box 8369, Duck, North Carolina 27949, or via e-mail at info@ducknc.gov. Per State Statute, only the name and address of people submitting written comments will be provided to the Board of Adjustment prior to or at the meeting as related to this request. A staff report will be available approximately five days in advance of the meeting at the Town Administrative offices at 1200 Duck Road or via the Town’s website at https://ducknc.gov/board-of-adjustment/
